This Membership Agreement (“Agreement”) regulates the membership rules of www.gewnkirish.com (“Website”). It is not possible to become a member of the Website without accepting this Agreement. This Agreement should be read carefully. With this Agreement, it will be accepted and undertaken that the site usage rules specified below will be complied with. If this Agreement is approved, it means that the following articles are accepted. According to your decision, you should click the (Become a Member) or (Cancel) button under the registration form.

1. Parties
1.1. ABCS GIDA KİMYA MAKİNA DANIŞMANLIK VE TİCARET LTD. ŞTİ. (“ABCS GIDA KİMYA”), located at Batısitesi Mah. 2310/1 cad no 45/2 Yenimahalle ANKARA, which conducts the activities of the www.gewnkirish.com website
1.2. Internet user who is a member of www.gewnkirish.com website (“Member”)

2. Subject and Scope of the Agreement
2.1. The subject of this Agreement is to determine the terms of use of the Member from the website www.gewnkirish.com owned by ABCS GIDA KIMYA.

2.2. In accordance with the Membership Agreement, the Member declares that he/she wants to become a member of the Website and wants to benefit from the services provided by ABCS GIDA KIMYA through the Website.

2.3. This Membership Agreement has been established only between the parties specified in Article 1 of this Agreement.

3. Membership System
3.1. The Member will determine a “member name” and “password” to use the www.gewnkirish.com Website. The “member name” to be determined by the Member cannot be contrary to the law, morality, public order or personal rights. Any responsibility that may arise from this belongs to the Member. This “Username” will be created only for the Member and cannot be used by another member. The Member is personally responsible for ensuring the security of the “Password” and any liability arising from its transmission to third parties belongs to the Member. The Member can always change the password that he/she has determined with his/her unilateral decision.

3.2. A Member who forgets his/her password will be directed to the flow where he/she will determine a new password by clicking on the “I Forgot My Password” button on the Membership login page. The Member must enter his/her username and password in order to connect to the services that require membership on the Website. This process is defined as logging in as a member.

4. Member’s Rights and Obligations
4.1. In order to gain membership status, this Membership Agreement must be approved. Apart from this, the candidate member who wants to become a member must be over 18 (eighteen) years of age and the information requested from him/her on the membership page must be filled with correct, up-to-date and valid information in accordance with the law and legislation. The Member who has not provided correct, up-to-date and valid information is personally responsible for all damages that may arise due to this reason and declares and undertakes to immediately compensate ABCS GIDA KIMYA for all damages that may be incurred due to the information being incorrect.

4.2. The Member accepts, declares and undertakes that the transactions carried out with the member name and password determined by him/her are carried out by him/her and that he/she is responsible for the transactions in question. The Member accepts, declares and undertakes that he/she cannot put forward any defense and/or objection that the transactions carried out using the member name and password were not carried out by him/her and/or that he/she cannot avoid fulfilling his/her obligations based on this defense or objection.

4.3. In the event that it is clearly obvious that the Member's membership information is not correct, ABCS GIDA KIMYA reserves the right to suspend or terminate the Member's membership. The Member is obliged to keep his/her personal information under the membership information heading up-to-date.

4.4. All kinds of information, opinions, explanations, etc. provided by the Member on the www.gewnkirish.com Website. ABCS GIDA KIMYA is a “hosting provider” in accordance with the Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed through Such Publications.

Therefore, it has no responsibility for the content on the Website that has not been published by it. It has no obligation to check whether the content in question on the Website is legal. Although ABCS GIDA KIMYA has no such obligation, it has the right to check the content in question at any time and, if deemed necessary, to block access and delete it.

Anyone who violates the rights of ABCS GIDA KIMYA or third parties with any visual, written or other content published on the Website is liable to ABCS GIDA KIMYA and/or third parties whose rights have been violated.
4.5. The Member accepts and declares that he/she is the buyer party in the distance sales contracts to be concluded for the purchases made through the Website.
4.6. The Member agrees to comply with the Membership Agreement and all conditions announced by ABCS GIDA KIMYA and the applicable legislation and ethical rules while benefiting from the services provided by ABCS GIDA KIMYA. If the Member acts contrary to this obligation, all legal and criminal liability belongs to the Member.

4.7. Upon the request of the authorized authorities, ABCS GIDA KIMYA may share the information it holds about the Member with the requesting authorities in accordance with the data transfer rules within the framework of the Personal Data Protection Law No. 6698 and other legislation. It will inform the Member about any developments in this regard.

4.8. Similarly, the personal data provided by the Member while registering to the Website or shopping from the Website may be shared with the parties who may be a party to the relevant dispute, subject to the data transfer rules, by informing the person whose information is requested, if necessary, in accordance with the Law on the Protection of Personal Data No. 6698, in disputes arising from forgery, fraud, misuse of the Website, and issues that may constitute a crime within the meaning of the Turkish Commercial Code No. 6100.

4.9. The Member accepts and undertakes that he/she will not use the Website for an immoral purpose, including the cases listed below.

4.9.1. Creating a database, record or guide on behalf of any person,

4.9.2. Creating fake Membership accounts using false information or misleading personal data and using these accounts in a manner contrary to this Membership Agreement or the law and legislation,

4.9.3. Using another Member’s account on the Website without permission,
4.9.4. Publishing the comment and scoring systems available on the Website outside the Website, using the Website for purposes other than its intended purpose,
4.9.5. Using the Website for the purpose of spreading viruses or in a way that would harm the Website,
4.9.6. Collecting any information about Members or Sellers, including e-mail addresses, without the permission of the relevant persons or taking actions that would constitute a violation of Law No. 6698 on the Protection of Personal Data,
4.9.7. Copying, publishing or using all or part of the content on the Website without the prior written permission of ABCS GIDA KİMYA without permission;
4.9.8. Using the services on the Website, campaigns and advantages offered on the Website with bad intentions and for the purpose of gaining unfair advantage,
4.10. The Member shall log in with his/her username and password each time in order to benefit from the Website services and shall not use robot and automatic login methods. The Member accepts that all information, content, materials and other content provided/used while benefiting from the services shall not contain any programs, viruses, software, unlicensed products, trojan horses etc. that may harm ABCS GIDA KİMYA and the Website, that he/she has taken/will take the necessary security measures and that he/she has taken/will take all other measures.
4.11. The Member accepts and undertakes that he/she shall not use the Website and Portal Services in a manner contrary to the legislation, in a manner that disrupts public order, is against general morality, disturbs and harasses others, for a purpose that is against the law at the national or international level, and in a manner that will infringe the intellectual and industrial rights of others. In addition, the Member accepts and undertakes that he/she shall not use his/her membership for the purpose of offering the services he/she receives to the use of third parties, or for commercial activities such as renting or offering for sale.
4.12. The Member accepts that all statements made by him/her on the Website are completely binding on him/her and are his/her personal opinion. Therefore, ABCS GIDA KIMYA has no responsibility for the statements in question.

4.13. ABCS GIDA KIMYA is the sole owner of all content provided by him/her on the Website. The Member cannot use, change, reproduce or benefit from them in any way without the written permission of ABCS GIDA KIMYA.

4.14. Since the Member has obtained all kinds of records and content obtained as a result of using the Website, he/she accepts that he/she is responsible for any malfunctions, information and other damages that may occur on the device he/she uses to benefit from the Website and that he/she will not assign any responsibility to ABCS GIDA KIMYA.

4.15. The Member accepts that he/she has reviewed the Cookie Policy on the Website.

4.16. Since all legal liability arising from the violation of the membership agreement belongs to the Member, ABCS GIDA KIMYA will be protected against all claims that may be directed to ABCS GIDA KIMYA.
4.17. ABCS GIDA KİMYA may process, store, and transfer to 3rd parties the personal data disclosed by the Member on the Website with their own consent without obtaining permission. In this context, please review our KVKK policy.

4.18. In case of cancellation of membership, the Member's personal data is stored within the scope of legal obligations, and other than this, it is eliminated by one of the methods of deletion, destruction or anonymization. Deletion, destruction and anonymization are carried out within the scope of our KVKK policy.

4.19. By approving this agreement and becoming a member of the Website, it means that this agreement and other terms referred to in this agreement have been read and evaluated by the Member, and that their results have been understood and accepted.

5. Other Rights that ABCS GIDA KİMYA May Use
5.1. By terminating the membership, the Member has the right to change or terminate the services provided, and the Member accepts this in advance and agrees that he/she will not hold ABCS GIDA KIMYA responsible for any responsibility.

5.2. ABCS GIDA KIMYA's delay or suspension of the operation of the system for a certain period of time does not grant the Member any right to make any claims.

5.3. The Website is operated for shopping purposes, and any communication, publication, information and data transfer to be made using this system may be blocked by ABCS GIDA KIMYA and the Member's use of the services provided may be terminated.

5.4. Although ABCS GIDA KIMYA has taken the necessary measures to ensure that the Website operates correctly and in accordance with the purpose for which it was designated, unforeseen errors may always occur. In this context, no guarantee is given that there will never be any errors or disruptions. In this context, ABCS GIDA KIMYA may make any changes to the services, content and necessary changes on the Website at any time without prior notice.

5.5. The Member shall not hold ABCS GIDA KİMYA, its shareholders, managers, employees responsible for any reason due to the Website.
5.6. The Members' personal data may be used in accordance with the cookie policy.
5.7. Reasons for the Member to disclose his/her personal data:
a- Official authorities' criminal complaint/investigation request and other requests,
b- Member's attack on the Website,
c- Membership under a different name despite his/her membership being canceled
d- Within the scope of the Cookie and KVKK policy
e- In order for the Member to fulfill his/her requests for the products/services he/she purchased from www.gewnkirish.com to be procured and delivered to him/her and for the fulfillment of his/her other requests, third parties
5.8. ABCS GIDA KİMYA has taken the necessary measures for the security of the Website (virus, Trojan horse, etc.) within the framework of the possibilities provided by technology. At the same time, personal data is also protected in accordance with the legislation. On the other hand, it is the Member's responsibility to take precautions on their personal devices. Therefore, the Member accepts that he/she is responsible for all damages that may occur in his/her area and that he/she is responsible for the damages he/she causes to ABCS GIDA KIMYA. In this context, please review our Privacy Policy.

5.9. ABCS GIDA KIMYA accepts that if it directs the Member to other sites through its own website, it is subject to the policies of these sites and that it will not hold ABCS GIDA KIMYA responsible for these sites.

5.10. ABCS GIDA KIMYA may make changes to the implementation of this agreement without having to notify the members for technical necessities that may arise in the future and for compliance with the legislation. It may change, cancel or add new articles to the existing articles of this Agreement within the scope of the changes. The Member can always find and read the Agreement on the Website. Changes regarding the services will be announced on the site and when necessary, the Member will be asked to approve the changes to the Agreement by clicking the relevant button in order to benefit from the services. However, failure to make this announcement does not prevent the renewed contract provisions from becoming effective for all members registered in the system as of the date of publication.

6. Protection of Personal Data
6.1. ABCS GIDA KİMYA may process, store and transfer the personal data shared by the Member within the scope of the KVKK and this Agreement to third parties within the scope of the processing purposes set forth in the Personal Data Protection and Processing Policy (“Policy”).
6.2. The Member has the right to;

6.2.1. Learn whether personal data has been processed,
6.2.2. Request information regarding personal data if it has been processed,
6.2.3. Learn the purpose of processing personal data and whether it is used in accordance with its purpose,
6.2.4. Know the third parties to whom personal data is transferred domestically or abroad,
6.2.5. Request correction of personal data if it is processed incompletely or incorrectly,
6.2.6. Request deletion or destruction of personal data within the framework of the conditions regarding deletion, destruction and anonymization set forth in the KVKK,
6.2.7. Request that the transactions made in accordance with articles (6.2.5.) and (6.2.6.) be notified to third parties to whom personal data is transferred,

6.2.8. Object to the emergence of a result against the Member by analyzing the processed data exclusively through automatic systems,

6.2.9. Request compensation for the damages incurred due to the unlawful processing of personal data.

6.3. In the event that the membership is terminated by the Member himself or by ABCS GIDA KİMYA, the personal data of the Member may be stored until the expiration of the periods stipulated by the legislation.

6.4. Without prejudice to the rights of the Relevant Person regarding the transferred personal data, personal data processed by ABCS GIDA KİMYA or third parties authorized by ABCS GIDA KİMYA within the scope of the membership may be transferred to third parties or authorized persons, institutions and organizations in the country and/or abroad to the extent and scope required by the membership transactions.

6.5. In case of termination of membership, in cases where the processing purposes regarding personal data are terminated, personal data is not required for the execution of this Agreement and the legislation does not foresee its storage or storage, the Member's personal data and other data will be deleted from ABCS GIDA KIMYA's databases.

6.6. Following termination of membership, the Member's requests for the deletion, destruction or anonymization of personal data in ABCS GIDA KIMYA databases will be evaluated in accordance with the procedures and principles stipulated in the applicable legislation.

6.7. The Member's requests regarding personal data from ABCS GIDA KIMYA will be evaluated within the periods stipulated by the applicable legislation.

6.8. In the event that links are provided from the www.gewnkirish.com Website to other websites or digital platforms within the scope of Article 5.10 of this Agreement, the Member is obliged to review the personal data processing policies of the said websites.

6.9. The Member accepts and declares that by signing this Agreement, he/she has been informed about the rights claims on his/her personal data, and that he/she has read and understood the Personal Data Protection and Processing Policy located at www.gewnkirish.com.

7. Evidence Agreement
The Member accepts that in disputes that may arise from this Membership Agreement, ABCS GIDA KIMYA’s official books and commercial records, as well as e-archive records, electronic information, electronic correspondence and computer records kept in ABCS GIDA KIMYA’s database and servers, will constitute binding, definitive and exclusive evidence and that this article is an evidence agreement within the meaning of Article 193 of the Code of Civil Procedure No. 6100.

8. Termination of the Agreement
8.1. Any of the Parties may terminate this Membership Agreement unilaterally and without compensation at any time. In the event of such termination, the Parties shall fully perform all rights and obligations that have accrued up to the date of termination.

8.2. If ABCS GIDA KİMYA determines that the Member has violated any article of this Membership Agreement or has a reasonable suspicion of such violation, it has the right to suspend, terminate, sue and pursue membership.

8.3. In the event of termination of this Agreement, Article 6 (Protection of Personal Data) of this Agreement shall apply to the Member's personal data.

9. Dispute Resolution and Applicable Law
Ankara Courts and Enforcement Offices are authorized in disputes regarding this Agreement. Turkish Law shall apply in the resolution of disputes.

10. Entry into Force
The Member's registration for membership means that the Member has read and accepted all the articles in the membership agreement. This Agreement is concluded and mutually entered into force at the moment the Member clicks the acceptance button and becomes a Member.
